1. Agreement to Terms

By accessing or using GetBidClean ("we," "us," or "our") services available at https://getbidclean.com, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, you may not access or use our services.

GetBidClean provides a subscription-based SaaS platform for generating janitorial bid proposals and related services.

2. Definitions

• "Service" refers to the GetBidClean platform, including all features, tools, and content.
• "User," "you," or "your" refers to the individual or entity using our Service.
• "Subscription" refers to the paid access plan you select (monthly or annual).
• "Free Plan" refers to the no-cost tier with limited features.
• "Pro Plan" refers to the paid subscription tier with full features.

3. Account Registration

3.1 Eligibility

You must be at least 18 years old and capable of forming a binding contract to use our Service. By registering, you represent that you meet these requirements.

3.2 Account Information

You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and update your account information
• Keep your password secure and confidential
• Notify us immediately of any unauthorized access

3.3 Account Responsibility

You are responsible for all activities under your account. We are not liable for any loss or damage from unauthorized use of your account.

4. Subscription Plans and Pricing

4.1 Available Plans

• Free Plan: $0/month - Basic features including unlimited bid calculations
• Pro Plan: $19/month (billed monthly) or $190/year (billed annually) - Full feature access including PDF generation

4.2 Free Trial

Pro Plan subscribers receive a 7-day free trial. During the trial:

• You have full access to Pro features
• No payment is required upfront
• You may cancel anytime before trial ends to avoid charges
• After 7 days, you will be automatically charged unless you cancel

4.3 Pricing Changes

We reserve the right to modify subscription prices with 30 days' advance notice. Price changes do not affect existing subscribers during their current billing period.

5. Payment Terms

5.1 Payment Processing

Payments are processed securely through our payment provider, Paddle.com. By subscribing, you agree to Paddle's terms of service and authorize recurring charges.

5.2 Auto-Renewal

IMPORTANT: Subscriptions automatically renew at the end of each billing period (monthly or annually) unless cancelled before the renewal date.

• Monthly: Renews every 30 days
• Annual: Renews every 365 days

You will be charged the then-current subscription rate upon renewal.

6. Cancellation and Refunds

6.1 Your Cancellation Rights

USA (All States): You may cancel your subscription at any time. For trial cancellations, no charges apply if cancelled within the 7-day trial period.

UK/EU (Consumer Rights Act / Distance Selling Regulations): You have a 14-day cooling-off period to cancel for a full refund if you have not fully used the Service.

Australia (Australian Consumer Law): You may cancel within 7 days if the Service is not as described or is faulty.

6.2 How to Cancel

Cancel through:

• Your account settings
• Paddle customer portal

7. Service Usage and Restrictions

7.1 Permitted Use

You may use the Service for:

• Creating janitorial bid proposals for commercial purposes
• Storing and managing your business data
• Generating PDF proposals (Pro Plan only)

7.2 Prohibited Activities

You may NOT:

• Share your account credentials with others
• Use the Service for illegal purposes
• Attempt to reverse engineer, hack, or compromise the Service
• Upload malware, viruses, or harmful code
• Scrape, copy, or redistribute our content without permission
• Create multiple accounts to abuse free trials
• Resell or redistribute the Service without authorization

8. Intellectual Property Rights

8.1 Our Content

The Service, including all software, designs, text, graphics, and trademarks, is owned by GetBidClean or our licensors. All rights reserved.

8.2 Your Content

You retain ownership of all data and content you upload ("Your Content"). By using the Service, you grant us a limited license to:

• Store and process Your Content to provide the Service
• Display Your Content back to you
• Create backups for data protection

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, GETBIDCLEAN'S TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

WE ARE NOT LIABLE FOR:

• Loss of profits, revenue, data, or business opportunities
• Indirect, incidental, special, or consequential damages
• Damages arising from third-party services (Paddle, Supabase, etc.)
• Damages from unauthorized account access due to your negligence

10. Governing Law

These Terms are governed by the laws of Morocco, where our business is located.

For users in specific jurisdictions, additional consumer protection laws may apply (UK Consumer Rights Act, GDPR, CCPA, Australian Consumer Law).
